Within is a trust-forward community. Hereâs who can join and how to care for your account.
- 18+ only. You must be at least 18 years old and able to form a binding contract.
- Account. Provide accurate information and keep it updated. You are responsible for your credentials and for all activity under your account.
- One person, one account. You may not share or sell your account.
2) Services & Features
Within helps people meet through their networks.
Within helps people meet through their networks using mutual-friend signals, profiles, messaging, and referrals. Certain features are optional (for example, contacts import and location) and can be toggled in your settings. We may add, modify, or remove features at any time.
No guarantees
We do not guarantee matches, dates, relationships, or outcomes.
No medical advice
Optional health-awareness fields (for example, Sickle Cell carrier status) are asked privately during registration only to help match people who opt in to share or care about that information. They are entirely optional, never shown on profiles, and not visible to other members, and they are not medical advice or diagnosisâalways consult a healthcare professional for personal guidance.
3) Privacy
Your use of the Services is also governed by our Privacy Policy and Cookies Policy, which describe what we collect, how we use/share data, and your choices.
By using the Services, you consent to those practices.
4) User Content & License to Within
You may post or provide content (text, photos, messages, profile information, feedback, etc.) (collectively, âUser Contentâ). You retain ownership of your User Content, subject to the licenses below.
- License to Within. You grant Within a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, modify, create derivative works (for example, reformatting), publish, display, and distribute your User Content solely to operate, improve, promote, and provide the Services (including moderation, safety, analytics, and backups).
- Feedback. You grant Within a perpetual, irrevocable, worldwide, royalty-free license to use suggestions or feedback you provide without restriction or compensation.
- Representations. You represent and warrant that you own or have all necessary rights to your User Content; your content and use of it on the Services will not violate law or third-party rights; and you have obtained any required consents.
5) Contacts Import & Referrals
If you choose to import contacts or send referrals:
- You direct Within to process identifiers (for example, names, phone numbers, emails) for contacts you select to enable mutual-friend matching and referral features.
- You represent you have a lawful basis to provide such contact information and to message those contacts.
- You may exclude or block specific contacts at any time; see the Privacy Policy for details on processing and retention.
6) Prohibited Conduct
You agree not to:
- Use the Services for any unlawful, harmful, or fraudulent purpose.
- Harass, threaten, dox, exploit, or harm others; send spam or scams.
- Post or transmit content that is illegal, pornographic involving minors, non-consensual, hateful, or infringing.
- Impersonate any person or entity, misrepresent your identity or affiliation, or mislead others.
- Data-mine, scrape, or crawl the Services except as permitted by robots.txt; reverse engineer or circumvent security.
- Use anotherâs account or attempt to gain unauthorized access.
- Use the Services in a manner that interferes with, disables, damages, or overburdens our systems.
- Use the Services for commercial solicitation without our written consent.
7) Safety, Moderation & Enforcement
We care about user safety. We provide tools to report and block users and content. We may review and moderate content (automated and human), and we may remove content or suspend/terminate accounts that violate these Terms or our Policies.

No background checks
We do not conduct criminal background checks and cannot guarantee user identity. Please exercise caution when deciding what information to share and when meeting others.
8) Subscriptions, Purchases & Billing
Certain features may be paid (for example, premium subscriptions). Purchases are processed by Apple App Store or Google Play.
- Billing. Your App Store account will be charged at confirmation of purchase per the App Store terms.
- Auto-renewal. Subscriptions renew automatically unless canceled at least 24 hours before the period ends.
- Manage/cancel. Manage or cancel in iOS Settings â Subscriptions or Google Play â Payments & subscriptions.
- Trials. If offered, trials convert to paid unless canceled before the trial ends.
- Refunds. Refunds are handled by the App Store provider per their policies (we typically cannot issue refunds directly).
- We may change pricing or add new paid features with notice where required.
9) Intellectual Property
The Services, including software, logos, and content (excluding User Content), are owned by Within or our licensors and are protected by intellectual property laws. Except for the rights expressly granted, no license is granted to you.
- Trademarks. âWITHIN,â âWITHIN SOCIAL,â our logos, and taglines are trademarks of Within Social, Inc. You may not use our marks without prior written permission.
- Patent pending. Our core algorithm and technique for matching are the subject of a patent application. Unauthorized use or reproduction is prohibited.
10) Third-Party Services & Links
The Services may integrate third-party services (for example, Firebase, Twilio, App Stores) or include links. We are not responsible for third-party services, which are governed by their own terms and privacy policies.
11) App Store Terms
When downloading from Apple or Google, you also agree to their terms. Without limiting the foregoing:
Apple-specific terms
Apple is not a party to these Terms and is not responsible for the Services. Apple has no obligation to furnish maintenance or support. In the event of failure to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
12) Disclaimers
THE SERVICES ARE PROVIDED âAS ISâ AND âAS AVAILABLE.â TO THE MAXIMUM EXTENT PERMITTED BY LAW, WITHIN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY MATCH OR OUTCOME IS GUARANTEED.
13) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WITHIN AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Cap on liability
Our aggregate liability shall not exceed the greater of $100 or the amounts you paid us (if any) in the 12 months preceding the claim. Some jurisdictions do not allow the exclusions/limitations above; in those cases, they apply to the fullest extent permitted by law.
14) Indemnification
You agree to indemnify, defend, and hold harmless Within and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneysâ fees) arising out of or related to your User Content, your use of the Services, or your violation of these Terms or applicable law.
15) Termination
You may stop using the Services at any time. We may suspend or terminate access immediately for any violation of these Terms or our Policies, or for risk, security, or legal reasons. Upon termination, your rights under these Terms end. Sections intended to survive (for example, IP, disclaimers, liability limits, arbitration) will survive.
16) Changes to the Services or Terms
We may modify the Services and these Terms. If changes are material, we will provide notice (for example, in-app or by email). Your continued use after changes become effective constitutes acceptance.
17) Dispute Resolution; Arbitration; Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS.
- Governing Law & Venue. These Terms are governed by the laws of the State of Delaware, without regard to its conflicts-of-law rules. Subject to the arbitration requirement, the exclusive venue for disputes that are not arbitrated is state or federal courts located in Delaware, and you consent to jurisdiction there.
- Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the Services that cannot be resolved informally will be resolved by binding arbitration administered by JAMS pursuant to its Streamlined Rules. Arbitration will take place in Delaware (or by video/teleconference if both parties agree). The arbitratorâs decision will be final and enforceable.
- Class Action Waiver. Disputes must be brought individually and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
- Small Claims & IP. Either party may bring qualifying claims in small-claims court; either party may seek injunctive relief for IP misuse in court.
- Opt-Out. You may opt out of arbitration within 30 days of accepting these Terms by sending written notice with your name, the email used for your account, and a clear statement of your wish to opt out to policy@datingwithin.com or to our mailing address. If you opt out, the venue and governing law provisions above still apply.
18) DMCA Policy
If you believe content infringes your copyright, send a DMCA notice to policy@datingwithin.com with:
- Your signature.
- Identification of the copyrighted work.
- Identification of the infringing material and its location.
- Your contact information.
- A statement of good-faith belief.
- A statement that the notice is accurate and, under penalty of perjury, you are authorized to act. We may remove content and terminate repeat infringers.
19) Communications & E-Sign Consent
You agree we may send you service-related emails/SMS (for example, security and legal notices). Marketing messages are optional and include unsubscribe options. By using the Services, you consent to electronic communications and signatures and agree that they satisfy legal requirements.
20) Miscellaneous
- Entire Agreement. These Terms and the Policies constitute the entire agreement between you and Within.
- Severability. If any provision is unenforceable, the remainder remains in effect.
- Assignment. You may not assign these Terms without our consent; we may assign them.
- No waiver. Failure to enforce is not a waiver.
- Force Majeure. We are not liable for delays or failures due to events beyond our reasonable control.
